Few would disagree that the protection of confidential information is a difficult area of the law, one which has been made even more so by the trend in recent years to use the equitable doctrine of confidence to protect privacy interests. Discerning the impact of the ‘privacy’ cases, and trying to make sense of the law of confidence as a whole, is a challenging task.
