Bundesgerichtshof refers AdWord question to the ECJ

German Federal Supreme Court (Bundesgerichtshof), advance press release No. 17/09 of 22 January 2009 concerning cases I ZR 125/07 (Bananabay), I ZR 139/07 (pcb), and I ZR 30/07 (Beta Layout).

The German Federal Supreme Court decides on the use of third party trade marks and company names as keywords in connection with so-called AdWord advertising by denying an infringing use in two cases, but refers the main question on trade mark use to the ECJ.
