‘Google AdWords’, keywords, metatags: a view from one German Higher Regional Court

Higher Regional Court of Frankfurt (Oberlandesgericht Frankfurt am Main), Case 6 W 17/08, 26 February 2008

The Higher Regional Court of Frankfurt has decided that using a competitor's trade mark as a keyword (‘AdWord’) in an internet search engine does not amount to trade mark infringement if the search result is clearly recognizable as an advertisement.
