The Registrar refused registration of the word CHOCOLATE as a trade mark in respect of portable communications apparatus on the basis that the mark was devoid of any distinctive character and consisted exclusively of a sign which may serve in trade to designate the characteristics of the goods for which registration of the mark was sought.
