The Court of Appeal for England and Wales resumed, following judgment by the European Court of Justice (‘the ECJ’) in April 2007 on questions it had referred to the ECJ, the hearing of certain appeals and cross-appeals against two High Court decisions concerning alleged trade mark infringement through co-branding or re-branding by parallel importers.
