Federal Circuit affirms Nilssen's 15 patents unenforceable for inequitable conduct
McDermott, Will & Emery LLP, Chicago
Ole K. Nilssen and GEO Foundation, Ltd. v Osram Sylvania, Inc. and Osram Sylvania Products, Inc., 504 F.3d 1223 (Fed. Cir. 2007).
The US Federal Circuit affirmed the District Court finding that it did not abuse its discretion in holding 15 of Nilssen's patents unenforceable due to his intentional withholding of material information during patent prosecution from the US Patent Office (USPTO).
