Focus Point: a threats action for copyright?
Point Solutions Ltd v Focus Business Solutions Ltd and another [2007] EWCA Civ 14, Court of Appeal, 23 January 2007
The Court of Appeal for England and Wales has recognized a declaration of non-infringement of copyright regime which is comparable to the statutory regimes for wrongful threats of registered trade mark, patent, and design right infringement. The Court used a four-step approach in assessing whether a declaration of non-infringement should be granted.
