The offering of patent-infringing goods for delivery subsequent to expiry of patents as patent infringment

Dr Gert Würtenberger
Wuesthoff & Wuesthoff, Munich

Bundesgerichtshof (Federal Supreme Court), Germany; 5 December 2006, XZR 76/05—SIMVASTATIN

Offering goods, which are (partly) the subject matter of a patent, shortly before expiry of the term of protection constitutes patent infringement, even if the advertising material indicates that the goods will be available on the market following expiration of protection.
