The Court of First Instance, dismissing a Community trade mark applicant's appeal against the decision to allow an opposition in part, affirms that the public's recognition of the opponent's earlier Community trade mark may be assessed in relation to the degree of recognition achieved by that mark through its close similarity to an earlier national registered trade mark belonging to the opponent.
