Yellow Pages mark held valid and infringed by split Supreme Court

The case concerns the validity of a trade mark registration for the word mark GULE SIDER (Yellow Pages), covering catalogues, as well as issues concerning trade mark infringement and a claim for damages. In this case the Norwegian Supreme Court (HR-2005-0195A) ruled that the term GULE SIDER had distinctive character with respect to, among other things, classified telephone directories, and was thus enforceable so as to prevent the use of that term by other parties.
